for Web and Graphic Design – Marko Sobloher (Hatrix)
These General Terms and Conditions apply to all contracts for web and graphic design services between Marko Sobloher (hereinafter "Designer") and his clients.
A contract is concluded upon the client's acceptance of a written offer from the Designer.
Quotes are valid for 14 days unless otherwise agreed.
Services include the items detailed in the offer. Extra services (e.g., more than two rounds of revisions) are billed separately.
All designs, graphics, and website structures are subject to Copyright Law.
Usage rights are transferred to the client only upon full payment of the agreed fee.
Unless otherwise agreed, only simple usage rights for the intended purpose are granted. The delivery of source files (e.g., .PSD, .AI, Figma files) is not included in the standard scope and requires additional compensation.
The client must provide all necessary materials (text, images, logos) in a timely manner and in a standard digital format.
The client warrants that they have the right to use all materials provided (especially photos and trademarks). The client is solely liable for any infringement of third-party rights.
Upon completion, the client is obliged to accept the work if it meets the agreed specifications.
Acceptance is deemed to have occurred if the client uses the work productively or does not object in writing within 7 business days of delivery.
Two rounds of revisions are included in the quote unless stated otherwise.
All prices are subject to statutory VAT.
The Designer is entitled to a 30% down payment at the start of the project.
If the project is canceled by the client before completion, the Designer is entitled to compensation for services already rendered, at least 50% of the total fee.
The Designer is only liable for intent and gross negligence.
The Designer assumes no liability for the legal (trademark or competition law) permissibility of the designs.
The Designer is not liable for technical failures caused by third-party providers (e.g., Cloudflare, hosting).
The Designer reserves the right to use completed works (screenshots, logos, etc.) as references on his website or social media, unless otherwise agreed in writing.
The law of the Federal Republic of Germany applies.
Place of jurisdiction is Pfullingen/Reutlingen, Germany.
